What To Do If You've Been Involved In A Rollover

First and foremost, make sure the vehicle is preserved. While it is normal to grieve during a loss of a family member or serious injury, if the vehicle is destroyed or lost by the family or insurance company, sometimes it is impossible to prove a products liability case. Some judges will not allow an injured victim or the family of a lost loved one to pursue their lawsuit if they have failed to act to make sure the vehicle is not destroyed or lost.

The best way to accomplish this is to contact a lawyer experienced in rollover accidents and roof crush. An experienced lawyer can assist you or your family in gathering and preserving evidence to protect your legal rights. Other must dos in a rollover roof crush case are as follows:

  1. An immediate site inspection by a qualified accident investigator/accident reconstruction engineer. This is important because skid marks, roll marks, gouge marks and other important pieces of evidence on and off the roadway may disappear in days or weeks after a rollover accident or a vehicle roof crush wreck.
  2. Gathering statements from witnesses, vehicle occupants, law enforcement individuals, EMS personnel and other first responders.
  3. Obtaining a bio mechanical or biomedical engineer to determine what part of the vehicle caused the injury or death.
  4. Pulling together the victim's treating physicians, together with hired experts such a life care planners and other consultants to ensure the victim gets the care they need after the lawsuit is resolved.

The most important thing is preserving the vehicle. As stated above, we cannot express to you and your family how important preservation of this piece of evidence is to a potential rollover or roof crush lawsuit. Our attorneys are available to assist in any means necessary to protect the vehicle from destruction.

The leading cause of death in van accidents is rollovers. Because of the speed involved in the accidents, untested environments, such as uneven or slick surfaces and the actual design of the vehicles themselves, crash and rollover tests do not meet real world circumstances. The current standards are simply not enough to replicate what happens on the highways that we drive on.

Faulty design is a leading contributor to rollover accidents, some even single car accidents. Here's a list of some safety issues that are common with SUVs, trucks and vans:

  • Weak roof structure - does not prevent roof crush - allows driver/passenger ejection
  • High center of gravity
  • Faulty Seat Belts
  • Seat back failures
  • Narrow wheelbase
  • Top heavy design with high center of gravity
  • Weak window glass that allows driver/passenger ejection
